Ontario has no damage deposit. The only deposit a landlord may hold is last month's rent, and it cannot be applied to cleaning or repairs. So the common worry about losing a deposit over dirty carpets rests on something that does not legally exist here.

What the law does require is ordinary cleanliness. A lease clause demanding professional carpet cleaning at move-out generally cannot be enforced. It asks for more than the Residential Tenancies Act requires. Below: what tenants actually owe, what counts as wear rather than damage, and why cleaning anyway is often still the cheaper choice.

Can a Landlord Keep Your Deposit for Carpet Cleaning?

No, because there is nothing to keep. Ontario permits exactly two payments up front. A rent deposit of no more than one month's rent, and a refundable key deposit matching the actual cost of the keys.

The Landlord and Tenant Board is explicit on the point. The rent deposit must go toward the last month's rent and cannot be used for anything else, such as damages.

Damage, cleaning and pet deposits are not permitted at all. A landlord seeking compensation for damage has two routes. Apply to the Landlord and Tenant Board during the tenancy, or file in Small Claims Court after it ends.

No pot of money is being held back, and that changes the negotiation completely. A carpet dispute becomes a claim someone must file and prove, not a deduction they can quietly make.

What Are Tenants Actually Required to Do?

Two obligations, and neither one mentions carpet cleaners.

Ordinary cleanliness. Three things cover it: vacuumed floors, no rubbish left behind, no spills sitting on the carpet.

Repair damage caused by you or your guests. Damage means something beyond normal use, such as a burn, a large stain or a tear.

A lease clause requiring receipts from a professional carpet cleaner asks for a higher standard than the Act sets. Terms contradicting the Residential Tenancies Act do not become enforceable because two people signed them.

Age matters in these arguments. A carpet already eight years old at move-in has little value left to damage. Adjudicators weigh remaining lifespan rather than awarding the price of new flooring.

Should You Clean the Carpet Anyway?

Usually yes, for reasons that have nothing to do with obligation.

It prevents the dispute entirely

A clean carpet plus a dated photo ends the conversation before it starts. A $250 clean against a claim for $2,000 of new flooring is cheap insurance.

It protects your reference

Landlords in a region this size talk to each other, and the next one may ask about the state you left the unit in.

It settles the pet question

Where a pet lived in the unit, odour is the first thing raised and the most expensive to argue about later. One clean and one dated photo close it.

One exception: a carpet already worn out when you arrived. Cleaning it does nothing for anybody, and the move-in photos matter far more.

What Should You Photograph?

  1. Every room at move-in, dated, before furniture arrives.
  2. Existing damage close up, with something for scale.
  3. The same angles at move-out, after cleaning.
  4. The cleaning invoice, showing the date and the address.

Four sets of photos and one receipt cover almost every dispute that reaches a hearing. Photographs taken at move-in are worth more than any argument made afterwards, because they establish what the carpet looked like before you lived there.

Every visit carries a $120 minimum. The last week before handover is usually the right slot. The unit is empty, nothing has to be moved, and the carpet stays clean until the keys change hands.

What If You Are the Landlord?

The rules cut both ways, and the practical advice is similar.

Keep a dated condition report and photographs from day one of every tenancy. Without them, a carpet claim is one person's word against another's, and the side with photos usually wins.

Use one of the two lawful routes: the Landlord and Tenant Board during the tenancy, or Small Claims Court afterwards. Deducting from last month's rent instead turns a recoverable claim into a losing one.

Book cleaning between tenancies rather than demanding it from the outgoing tenant. One clean costs less than a hearing, the unit shows better, and an empty unit cleans quickly.
